Qualified Domestic Relations Order (QDRO)
Florida Legal Services You Can Trust

Don’t Leave Your Retirement Behind After Divorce

If you’re going through a divorce or if you have already finalized one, you may be surprised to learn how complex it can be to divide retirement accounts like 401(k)s, pensions, or other employer-sponsored plans. Even when your Final Judgment awards you a portion of these accounts, that doesn’t mean the money is automatically transferred.

In most cases, a separate Court Order—called a Qualified Domestic Relations Order (QDRO)—is required to divide the funds. Often, it’s the last and most technical step in the divorce process.

Even for simple plans, the QDRO process can take 30 to 90 days or more, depending on how quickly the plan administrator reviews and accepts the order.
Unfortunately, many people don’t realize they need a QDRO until it’s too late. Years can pass before discovering that the retirement funds you were awarded are no longer available. Without a properly prepared QDRO, your right to those assets may be lost forever.

The Risks of Delaying Your QDRO After Divorce

Delaying your QDRO can lead to lost retirement benefits. Learn why timing matters and how to protect your share after divorce in Florida. Most retirement plans require the QDRO to be submitted and approved well before retirement begins. Waiting can lead to loss of benefits, delays, plan rule changes, additional paperwork, and even require court intervention to enforce the divorce judgment.

A QDRO Is Not Just a Form. It’s a Court Order.

Each retirement plan has its own rules, and every account requires a QDRO tailored to that specific plan. This is not something that can be handled by a generic template or document service. A QDRO should be drafted by a licensed attorney who understands Florida family law and is familiar with the technical and legal nuances of retirement division.

Many attorneys choose not to prepare QDROs due to their complexity—and for good reason. Each plan administrator has different procedures, and even accounts within the same plan may require different language. There is no such thing as a “standard” QDRO.

Our Law Firm Offers Trusted Legal Guidance for Florida QDROs.

At Christian D. Smed, P.A., we focus exclusively on Florida family law. Attorney Christian D. Smed is licensed in Florida and provides full-service QDRO preparation—not just drafting, but also the legal review, plan compliance, and court coordination required to secure your benefits.

Understanding Pricing Differences

We offer flat-fee QDRO services ranging from $800 to $1,200 per account, depending on the plan type and complexity.

When comparing QDRO services, we encourage you to ask:
  • Does the quoted price include filing the court order and following through to final plan approval?
  • Who will communicate with the plan administrator?
  • Who will communicate with the Court?
  • Will a Florida-licensed attorney be available to answer my questions?
  • What am I expected to do on my own?

QDRO Review: Don’t Leave Benefits Behind

Not sure if your QDRO gives you everything you’re entitled to? Mistakes in QDROs are common—and costly.

Have your QDRO reviewed by a Florida attorney before it’s finalized or filed. We make sure:
  • Your share of retirement benefits is fully and clearly stated
  • No options or benefits have been left out
  • Your rights are protected under Florida and federal law
  • The order complies with the specific plan’s requirements
You only get one shot at getting it right. Don’t sign or submit a QDRO without making sure it protects your interests.
