Understanding the purpose
A Qualified Domestic Relations Order (QDRO) is a special court order required to divide certain retirement plans in a divorce. Its primary purpose is to legally direct a retirement plan administrator to distribute a portion of a retirement account—such as a 401(k) or pension—from one spouse to the other without triggering early withdrawal penalties or tax consequences.
Without a QDRO, plan administrators cannot release funds to a non-employee spouse, even if the divorce judgment states the account should be divided. The QDRO ensures the division is recognized by the plan under federal law (ERISA) and allows the non-employee spouse (called the "alternate payee") to receive their share directly.
